Frequently Asked Questions:

What type of cases?

What types of case do you handle?

I am experienced in all areas of criminal defense. I also represent people seriously injured by the negligence of others. This is known as Personal Injury. I also represent people that have been injured as a result of the negligence of doctors. This is known as Medical Malpractice.

Defense Fees?

How much do you charge for Criminal Defense?

I do not charge for the initial consultation. That consultation is free. This first meeting is usually about an hour and sometimes longer depending upon the issues in your case.

The fee in your case is dependent upon the work necessary to properly prepare your case. I charge a flat fee. A flat fee is a set fee that covers the attorney’s fee for the duration of the case.

Some attorneys charge an hourly rate. They may initially only require a small retainer. You should know that once the retainer has been earned they will be requiring more money to continue representing you. While my fee has a cap, an hourly retainer has no maximum.

I charge a flat fee so the client feels more comfortable contacting me and discussing their case without the worry of how much the phone call or interview will cost. I charge a flat fee because I do not want the client to worry about the amount of work being conducted on their case. Work on a flat fee basis is not constrained by the client’s ability to pay. It is only governed by the necessity of properly preparing and presenting the client’s case.

This fee will be discussed with you in more detail at your FREE initial consultation.

Personal Injury Fees?

How much do your charge for personal injury cases?

I represent people in Personal Injury matters on a contingency fee basis. This means that if your case is not settled or won in your favor you will not pay legal fees.

Who will I meet with?

Who will I be meeting with at the first free initial consultation?

Only David Sereno will conduct that confidential interview. Your charges are serious. You deserve to speak with the Senior attorney in the office in Wailuku, Maui.

What do we discuss?

First, you should know that everything discussed at this consultation is confidential.

I first anticipate that the confidential consultation will last approximately one hour. Some consultations are longer and some are shorter, depending on the complexity of the case. In either event, it costs you nothing.

We will discuss the legal process. I will inform you of what type of legal events may be happening to you during the duration of your case.

We will then discuss your case in detail. During that discussion I will begin to develop defenses that I believe are available to you in your case based upon the information that you provide. I will discuss any strengths or weaknesses that I detect. We will discuss any special issues that I see based upon my interview with you.

I will answer, or attempt to answer, any and all questions that you may have.

Finally, we will discuss the attorney’s fees.

Regardless of whether or not you retain me to represent you, I believe that you will leave our legal office with valuable information regarding your case.

Your guarantees?

What can you guarantee?

I cannot guarantee any result. I can only guarantee that myself and my legal team will work tirelessly on your behalf.

Years in practice?

How long have you been practicing law?

I have been practicing law in the State of Hawaii since 1988. As a Maui lawyer, we are located in Wailuku, Hawaii.

All islands in Hawaii?

Do you represent people on all islands in Hawaii?

As a Maui lawyer, our law office is on Maui in Wailuku. I do, however, travel to all islands in Hawaii to represent clients for medical malpractice, criminal defense and personal injury cases.

Will you judge me?

Will you judge me based upon my charges or what I tell you?

My job as your Maui lawyer is not to judge you. My job and my passion is to represent you effectively and zealously. I believe an attorney who judges their client cannot properly represent that client. The clients do not seek out quality legal counsel to be judged. They seek out quality legal representation so that their rights can be properly protected and to obtain the best possible result. That is my goal. That is my mission.

When can we meet?

When can we meet for this free consultation?

While I prefer to meet with clients during our typical work day, I do meet with clients on the weekend to discuss their case. I understand that you are nervous and scared. Your appointment will be made at the earliest possible time.
